Terms of Service

By accessing or using Ayocard! ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and Ayocard! regarding your use of the Service.

Ayocard! provides a digital calling card and payment platform that allows users to:

• Create and manage digital business cards
• Order physical NFC-enabled cards
• Share contact information via NFC tap or QR code scan
• Display payment links and QR codes
• Track card views and engagement analytics

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

Pricing

Our Service offers different subscription plans. Prices are displayed in Philippine Pesos (PHP) and are subject to change. We will notify you of any price changes before they take effect.

Payment Processing

All payments are processed through PayMongo. By making a purchase, you agree to PayMongo's terms of service. We do not store your payment card details.

Refunds

For physical card orders, refunds are available if the card has not been printed yet. Digital subscriptions are non-refundable after activation. Contact support for refund requests.

When ordering physical NFC cards:

• Delivery times are estimates and not guaranteed
• You are responsible for providing accurate delivery information
• Risk of loss transfers to you upon delivery to the carrier
• Cards are printed on-demand and cannot be returned once printed

You agree NOT to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Impersonate any person or entity
• Upload malicious code or interfere with the Service
• Collect user information without consent
• Send spam or unsolicited communications
• Engage in fraudulent activities
• Display offensive, harmful, or inappropriate content

Our Content

The Service, including its design, features, and content, is owned by Ayocard! and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

Your Content

You retain ownership of content you upload (profile images, contact information). By uploading content, you grant us a license to use, display, and distribute it in connection with the Service.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We reserve the right to suspend or terminate your account if you violate these Terms or engage in activities harmful to the Service or other users.

You may close your account at any time through your Privacy Settings. Upon account closure:

• Your profile and cards will be deactivated
• Your data will be deleted according to our retention policies
• Active subscriptions will not be refunded

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We are not responsible for:

• Third-party services or links on your card
• Payment disputes between you and your customers
• NFC compatibility with all devices
• Loss of data due to factors beyond our control

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AYOCARD! SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless Ayocard!, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Metro Manila, Philippines.

We may modify these Terms at any time. Material changes will be notified via email or through the Service. Your continued use after changes constitutes acceptance of the modified Terms.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
